Transfer to force resignation is not valid: Ricoh workers win the lawsuit





Ricoh, an imaging and electronics company, forcibly tried to reduce its workforce by nearly 10,000 in summer 2011. On November 12, 2013, the Tokyo District Court made a decision on the transfer of two Ricoh employees who refused to accept resignation. It was victorious for the workers. Both of them were developers of digital combined machines but were transferred to irrelevant and unskilled positions at a warehouse. The judgment said that the transfer to force resignation is an abuse of the power to shuffle personnel and is not valid. Unfortunately, Ricoh immediately appealed to the High Court, but we really thank for your support to the workers. (SUZUKI Takeshi, Tokyo Managers’ Union)

リストラ退職勧奨の出向は無効~リコー労働者、勝利判決かちとる

2011年夏に1万人規模のリストラを強行したリコーで、退職勧奨を拒否した労働者に対する嫌がらせ出向の是非を争う裁判の判決が、1112日東京地裁でありました。その結果、リストラ退職勧奨を目的とした出向は人事権の濫用であり無効であるとの勝利判決を勝ち取りました。残念ながらリコーは即日控訴しましたが、みなさまにお礼申し上げます。当日の状況や判決内容については追って報告いたします。(東京管理職ユニオン・鈴木剛)
