Victorious Settlement Achieved in "Dismissal for Loss of Freshness" Case

In the suit that a dismissed female worker filed against Chat Noir Co, the operator of a coffee shop chain Caffe Veloce in 2011, demanding compensation for unfair dismissal on gender discrimination,  the two parties reached a settlement agreement on Feb. 16 at the Tokyo High Court. The worker affiliated with the Tokyo Youth Union had worked at a Veloce coffee shop in Chiba for nearly nine years in total as a temporary employee. She lost her job in 2013 as the employer introduced a rule under which no temp employment be extended beyond four years, claiming that workers were no longer "freshness enough" after working for four years.  The Tokyo District Court rejected the plaintiff's demand in July 2015, but the worker appealed to the high court where the judge had doubts with the lower court's judgment and proposed a settlement with a payment of money from the company to the appellant. （Excerpts from the statement of the Tokyo Youth Union dated Feb. 17, 2016)

鮮度で解雇」カフェ・ベローチェ事件が解決～勝利和解かちとる

 2 月16日、カフェ・ベローチェ４年雇い止め事件が東京高裁で和解成立した。首都圏青年ユニオンは「勝利和解」として声明を発表した。以下声明か ら。…２０１６年２月１６日、東京高等裁判所民事第５部において、「カフェ・ベローチェ」を運営する株式会社シャノアールが、同千葉店で足かけ９年にわ たって、アルバイトとして勤務してきた女性労働者（控訴人）を、雇止めした事件において、和解が成立した。２、裁判上の和解の内容に従い、和解の内容を下 記のとおり発表する。今般の和解は、控訴人が理不尽に職を奪われたのち、地裁判決で不利な立場に立たされた控訴人と組合にとって、高裁の裁判官が、原審の 判断に疑問を呈したうえで提案した内容を元に進められた和解協議の末得られたものである。内容的にも、解決金が得られたこと等から、組合は、勝利和解と評 価している。 詳細　＊写真＝和解成立を発表する記者会見

Female worker protests against unfair verdict on gender discrimination

 The Tokyo District Court on July 31 rejected the plaintiff’s demand that Chat Noir Co, which runs a cafe chain called Veloce, pay compensation for unfairly dismissing her on gender discrimination. The plaintiff worked for four years and 11 months at Veloce and was dismissed because she is no longer “fresh enough,” the company claimed. She decided to join a union and file a lawsuit as she was treated like an object and deprived of her dignity for being discriminated against due to her age.

「鮮度でクビ」を追認！～「カフェ・ベローチェ雇止め事件」で不当判決

 本日（7/31）、東京地方裁判所民事第１９部（吉田光寿裁判官）は、「カフェ・ベローチェ」 を運営する株式会社シャノアールが、同千葉店で４年１１ヶ月もの間アルバイトとして勤務してきた女性 労働者（原告）を雇止めした事件において、同社に対する地位確認請求、慰謝料請求をいずれも否定する 極めて不当な判決を言い渡した。本件の原告は、長年貢献してきた被告から、モノのように扱われ簡単に 辞めさせられたこと、年齢を重ねた女性を鮮度が落ちたと評され、人として尊厳を奪われたことに深く傷 つき、本訴訟を提起した本判決は、被告の組織的かつ脱法的な雇止めを容認し、原告の権利を踏みにじる ものであり、極めて不当な判決である。首都圏青年ユニオン及び同顧問弁護団は、不当な雇止めと人間の 尊厳を奪うことを容認した本判決を断固として糾弾し、労働者の権利を守るため、今後も徹底的にたたか い抜く決意である。（首都圏青年ユニオン） 声明全文

‘I will fight against this outrageous age bias’—a struggle against a cafe chain

“Only young applicants need apply, and workers will be dismissed in four years when they start to lose their freshness.”The remark was made by the president, NAKAMURA Ayumu, of Chat Noir Co., which runs a cafe chain.

 On July 7, a woman who had worked for the cafe for nine years was dismissed as she was “no longer fresh enough,” according to the company. She joined Tokyo Youth Union and filed a lawsuit.

 "I worked strenuously for Cafe Veloche, one of the franchises, in Chiba for nine years,” she said during the campaign against the company in front of its main office in Tokyo’s busy Ikebukuro district. “When I turned 28, the company terminated my contract for lack of freshness. It is inadmissible that I was not considered of any value at all as a woman nor a human.

 The lower court decision is to be handed down at the end of July.

 About 5,000 are working at Cafe Veloche as part timers while only 300 are full time, which shows how the company is making a huge profit by exploiting workers.

The action represented the voices of 5,000 workers. Her struggle continues until the unfair age discrimination is abolished. (By M)

「鮮度」でクビを切 るシャノアールを許せない！～本社前で宣伝行動

 「若くない女性はいらない、鮮度が 落ちるから4年で辞めてもらう」。そんなことを公言して実行しているのが、カフェ・ベローチェを展開し ている㈱シャノワールだ。社長が女性の中村歩氏であることにも驚く。7月6日昼、そのシャノアール本社 のある東京・池袋のサンシャインビル前で抗議の宣伝行動が行われた。ベローチェ千葉店に約9年働いてい たが「4年条項」で28歳で雇い止めされた女性がいる。彼女はこんなやり方は許せないと首都圏青年ユニオ ンに加入し、「雇い止め撤回」の裁判を起こしてもう4年闘っている。この日は、その一審判決を7月末に 前にしたアピール行動だった。女性は訴えた。「9年間会社のために一生懸命は働いてきた。鮮度と言わ れ、女性として人間としての価値を否定されたことはどうしても許せない」。ベローチェで働く非正規労 働者は約5000人で社員は300人に過ぎない。膨大な非正規を使い捨てにして暴利をむさぼっているのが、 ㈱シャノアールだ。ユニオンの闘いは5000人の思いを代弁する闘いでもあった。（М）
