The Supreme Court rules tour agency respect worker rights of tour guides




The Supreme Court ruled on Jan. 24 that the tour agency Hankyu Travel Support (HTS) pay overtime to its tour guides. One of the labor disputes that lasted for six years demanded that the company respect overtime hours of the tour guides. HTS had long failed to pay overtime hours because it regarded these hours as regular working hours. The union expressed its appreciation to all the supporters. This was a landmark victory for the tour guides nationwide. With this verdict, another legal dispute that was pending will confirm its verdict in the lower court. Hankyu Travel’s Refusal to Negotiate Is Unfair Labor Practice—Union Prevails




Central Labor Commission ruled on November 29 that Hankyu Travel committed an unfair labor practice by refusing collective bargaining with Hankyu Travel Support Branch (HTS) of the National Union of General Workers, Tokyo Tobu. The union members are treated as temporary workers by Hanky Travel. This is HTS’s victory! The union consistently insisted that it was clear Hankyu Travel had an employer responsibility as far as amending long working hours or travel plans. And if Hankyu Travel did have an employer responsibility, it also needed to respond to collective bargaining with the union. (By Sugano, NUGW Tokyo Tobu)



阪急交通社の団交拒否は不当労働行為~中労委が組合勝利命令
 
旅 行添乗員で組織する東部労組HTS(阪急トラベルサポート)支部が派遣先である阪急交通社と争っている団交拒否問題につき、中央労働委員会は本日11 29日、組合側勝利命令を発しました。これにより、阪急交通社が行った団体交渉拒否は不当労働行為(違法行為)であることが改めて中労委により断罪された ことになります。HTS支部の勝利です! 組合は、直接の雇用主である阪急トラベルサポートでは決定できない事項、たとえば労働時間の管理による長時間労働の是正などについては、ツアーを企画する 阪急交通社が実質上の使用者として責任を負うことは明らかであり、そうである以上、阪急交通社には、HTS支部との団体交渉に応じる義務がある、との主張 を中労委においても行ってきました。中労委は組合の主張に即した判断を行っています。(東京東部労組・菅野)

Good News for Temporary Tour Conductors: High Court overturns District Court's decision in a case on distorted work hours measurement




Tokyo High Court overturned a lower court's decision on March 7 in a lawsuit that temporary tour conductors affiliated with the Hankyu Travel Support (HTS) Local of the National Union of General Workers’ Tokyo Tobu filed against the travel company over the method to measure work hours and calculate overtime payments. The plaintiffs claimed that the company failed to calculate the overtime hours because of the nature of their work. HTS claimed that overtime hours were counted in their required work hours and overtime pay in their salary. Tokyo District Court approved of the company's claim in September 2011, though ordered it pay unpaid overtime hours and fines.
The high court judge, OTAKE Takashi, approved more overtime hours than the District Court did and ordered HTS pay a total of about 27 million yen including fines. In addition, the judge dismissed the company's claims on the calculation of work hours and overtime for tour conductors that the lower court endorsed.
"We have been struggling for nearly 4 years. We strongly urge HTS to respect the high court's order and treat tour conductors appropriately. We also hope that today's ruling will have a positive impact on the working conditions of all colleagues in the industry," said OSHIMA, one of the plaintiffs, in the press conference. 派遣添乗員に朗報~「偽装みなし労働」裁判、高裁で逆転勝利

派遣旅行添乗員で組織する東部労組HTS(阪急トラベルサポート)支部が闘っている「偽装みなし労働」撤廃を求める不払い残業代請求裁判。2審の判決が37日にあり、組合が逆転勝利判決をかちとりました。東京高裁第5民事部大竹たかし裁判長は、1審東京地裁の判決を変更し、不払い残業代を増額して認定しました。付加金(ペナルティ)を含めると、総額は約2700万円。その上で、高裁は、「偽装みなし労働」を容認した1審判決を支持せず、「みなし労働」の適用可否についての判断も変更しました。原告の大島さんは会見で、「4年ちかく闘ってきた。会社は判決に従い、添乗員の処遇を改善するべき。この判決が自分たちだけではなく、すべての会社に波及することを望みます」と訴えました。(東部労組・菅野)

Victim’s mother makes 15-minute speech at collective bargaining on sexual assault at Toyoko Inn


“Why can you not think of the consequences of a woman working on the night shift and for 25 consecutive hours,” a mother of a sexually assaulted victim said at a collective bargaining session with Toyoko Inn and National Union of General Workers, Tokyo Tobu, on Dec. 5 in Tokyo. Her daughter joined the union after she was sexually assaulted by a hotel guest. “My daughter just started working before she fell victim to this assault,” the mother said in tears. “I feel like my daughter’s life was destroyed. 母親 15分にわたって大演説~東横インの性的暴行事件で初の団体交渉
「東横イン」(本社・東京都大田区)の女性フロント従業員が宿泊客から性的暴行を受けた事件について、女性が事件後に加入した全国一般東京東部労組と会社との初めての団体交渉が12月5日、都内の弁護士事務所で開かれた。被害女性と母親が上京し東部労組スタッフとともに団交に出席。母親は涙を流しながら15分間にわたり大演説、「25時間勤務で休憩も仮眠も取れず、深夜も女性1人で働かすという危険をなぜ想定しないのか。スタッフが危険ということは客にとっても安全ではない。娘は社会人として働き始めた矢先の事件。母親にとって娘の一生をズタズタにされた思いだ」と訴えた。(東部労組・須田) ・当該ブログ
