Packaged settlement for“Ari-san” moving company dispute ~ The worker becomes a full-time staff of the Union

 On February 13, 37 workers of a moving company, “Arisan Mark no Hikkoshisha” including NOMURA Yasuhiro( photo left) finally agreed to a packaged settlement in a dispute demanding the company of payment of overtime and the return of indemnity for accidents in the Central Labor Relations Commission. It is about three years since Nomura first consulted Precariat Union, and it was a long road. Nomura revealed his real name taking this opportunity. The provisions of the settlement clearly state that the company will not demand the members of Precariat Union the charge for indemnity for accidents if there is no intention or no heavy negligence.“Ari-san” moving company settles by paying the settlement money  to the union members. The amount of the settlement money is not disclosed. At the press conference Nomura said, “The power difference between the worker and the employer is outright. I want many people to join the union. 「アリさんマークの引越社」争議が一括和解〜野村さんユニオンの専従職に

2月13日、「アリさんマークの引越社」ではたらく野村泰弘さん（写真左）を含む従業員ら計37人が、会社に対して、残業代の支払いや事故による弁償金の返還等を求めていた労働争議は、中央労働委員会にて、ついに一括和解した。野村さんがプレカリアートユニオンへ相談してから約３年。長い道のりだった。野村さんは、この日を契機に本名を明かした。和解条項には、プレカリアートユニオンの組合員に対し、故意や重い過失がなければ弁償金の負担を求めない旨が明記された。「アリさんマークの引越社」のグループ会社ではたらく同組合員に対して労働紛争の解決金を支払うことで和解した。和解金額は非公開だ。会見で野村さんは、「労働者と使用者の力の差は歴然としている。是非、組合に入ってほしい。しっかりした労働環境を、自分の力で切り拓いてほしい」と語った。野村さんは引越社関東を退社し、プレカリアートユニオンの専従職となるという。（土屋トカチ)

Saying “No” to the Shaming of Union Members ～ Tokyo Labor Relations Commission Orders Labor Union Victory in “Arisan Mark no Hikkoshisha” Dispute

 

On August 23^rd, the Tokyo Metropolitan Labor Relations Commission issued an order against the moving company Arisan Mark no Hikkoshisha, known for its ant logo, to resolve its “unfair labor practices” over allegations that the company reassigned a union member to paper-shredding job and put up photo of the member who was punitively dismissed for engaging in union activities. The order was a sweeping victory in favor of the union, in which the Labor Relations Commission, with clarity and detail, ruled the company’s practices illegal. While in the past the commission has ordered companies to issue a statement of apology, it is extremely rare for the commission to demand that the company include the statement in its in-house newsletter and send it to all of its employees. Using the commission’s ruling as leverage to resolve the ongoing class action lawsuit, we will continue the fight to change the core of the company that has become infamous for thrusting the costs incurred from damaged goods onto its workers, who call them “antlion’s death trap” for the high price. シュレッダー係配転はダメ！～「アリさんマークの引越社」都労委が組合勝利命令

アリさんマークの引越社の不当労働行為問題（組合員をシュレッダー係の業務に就かせたことなど、罪状ペーパーを貼りだしたことなど）に関する東京都労働委員会の不当労働行為救済命令が、8月23日、交付されました。完全勝利命令でした。明確に詳細に会社の不当労働行為問題が違法と認定されました。謝罪文の掲示を命じることはあっても、反省文を社内報に掲載し、全従業員の自宅に送付することを命じる不当労働行為救済命令は非常に珍しいです。これをテコに集団訴訟全面解決を実現し、アリ地獄と呼ばれるほどの弁償を社員に強いるような会社の体質を改めていきます。引き続きご支援のほど、お願いいたします。ぜひ会社に「都労委命令を守れ」とお伝えください。（プレカリアートユニオン・清水直子）
