Worst Possible Verdict ~ Tokyo High Court Upsets Lower-Court’s Ruling


Tokyo High Court turned over the lower-court’s verdict on the singing of “Kimigayo” national anthem on Jan. 28. The lower court ruled on Sept. 21, 2006, that freedom of thought and conscience is granted to educators and there should be no obligation to sing the national anthem. It also ruled that the coercion by the Tokyo Metropolitan education board was against constitution. It was a landmark verdict and encouraging to the teachers who tried to believe in their conscientiousness. But the verdict at Tokyo High Court turned out miserable. Expressions on the faces of about 200 plaintiffs and supporters stiffened when they heard the report in front of the court house. “The judge made the decision even before he considered our plea and claims. It was the worst verdict we could think of,” the head of the plaintiffs, Miyamura, said in a microphone. “The Japanese court is dead!” By M. 考えられる中で最悪の判決!~東京高裁、難波判決を180度ひっくり返す
 1月28日午後1時すぎ、東京高裁(民事24部・都築弘裁判長)で「君が代」強制をめぐる裁判の判決があった。原告は都の教職員395人。一審の難波判決(2006年9月21日)は、「教員には思想信条の自由があり国歌斉唱義務はない。都教委の強制は憲法違反」という画期的なもので、良心を貫く教員を鼓舞したものだった。しかし、この日の控訴審判決は無残なものだった。判決が伝えられると、裁判所前で待っていた約200人の原告・支援者の顔がこわばった。宮村原告団長はマイクを握り「すべて門前払いの内容。考えられる中で最悪の判決だ」と震える声で語った。ある支援者は裁判所に向かって「日本の裁判所は死んだのか!」と叫び続けた。(M) ・動画(UnionTube) *写真=報告する弁護士(中央)と宮村原告団長(右)

Do Not Reprimand for ‘Kimigayo’ ~ Kimiko Nezu, others protest at Tokyo Govt Office


As March approaches, Tokyo educators begin to show anxiety and frustration. That’s because teachers will be forced to stand up and sing Kimigayo national anthem. To fight off the negative feeling, 21 members of a group to stop Tokyo government from dismissing teachers for refusing to comply with Kimigayo order protested at Tokyo Government Office on Jan. 24. Kimiko Nezu (photo), who was suspended for six months at three different times in the past but still decided to refuse to stand up for the national anthem, spoke through a microphone. “I would never be able to support a government that tries to mold children to be its tools,” she said. The group ended up distributing 850 leaflets with political satire on Tokyo Governor Shintaro Ishihara, who is known for his rightist views. In seven years of Ishihara administration, 430 teachers were reprimanded. In the end, no teacher could say his/her opinion, and schools in Tokyo are almost being suffocated by his rule. 「君が代」処分をするな!~根津公子さんら都庁前で宣伝行動
 3月が近づくと都の教職員の不安・イライラが募ってくる。卒業式でまた「君が代」強制が行われるからだ。そんなムードを吹き飛ばすように、1月24日午前8時、「君が代」解雇をさせない会メンバー21人は、都庁前で元気に街頭宣伝を行なった。過去に停職6月処分を3回受け、今年も「不起立」を決意した根津公子さん(写真)がマイクを握り、「子どもたちを国家の具にすることには加担できない」と訴える。石原都知事を風刺した漫画入りチラシの受け取りはよく、850枚を撒ききった。石原都教委のもと7年間で、430名という大量の教職員が処分された。その結果、もの言う教員がいなくなり、学校は管理教育で「窒息寸前」の状態になっている。「解雇させない会」は、3月にむけていっそう運動を強めていく予定だ。(M) 解雇させない会HP

We Want to Ask Japan’s Court House ‘What is Democracy?’ ~ ‘Kimigayo’ Third Lawsuit


On March 2, just before the graduation, school orientation season starts, a third lawsuit was filed on “Hinomaru-Kimigayo” in Tokyo. About 100 supporters and plaintiffs gathered in front of the Tokyo District Court. One social sciences teacher said at a press conference, “We have never been accused of refusing to stand up for the national anthem by parents or students.” “I want to ask the court. Is democracy only for the majority?” Other plaintiffs (like one music teacher) said, “Playing piano does not only mean to move your fingers. 裁判所に問いたい!民主主義とは何なのか~「君が代」第三次提訴
 卒・入学式シーズンを目前にした3月2日、東京「日の丸・君が代」処分取消訴訟(東京「君が代」裁判)の第3次の提訴が行われ、東京地裁前には100名の原告、支援者が集まった。記者会見で原告代表の1人(社会科教員)は、「私たちは、君が代斉唱で着席した事で、親、生徒から抗議を受けたことはない」「私は裁判所に聞きたい!民主主義とは、多数者のためだけのものか」、また他の原告(音楽科教員)は、「ピアノを弾くということは、単に指が動けばいいということではない。『君が代』を弾くことを通じて生徒や式参列者にも私の手と体を使って『歌いなさい』ということは、私にはどうしてもできなかった」と語った。(湯本雅典)・動画(UnionTube) *写真=地裁に入場する提訴団

They Couldn't Fire Nezu! --Tokyo Metropolitan Board of Education Reprimands 12 Teachers


On March 31, the Tokyo education board issued an order against the teachers who refused to stand up for Kimigayo national anthem. Shortly after 3 p.m., Kimiko Nezu came out of a building with a document in hand (see photo). She was full of smiles. The moment she made a circle with her hands, a group of supporters waiting outside screamed in joy. On March 26, when they received the "worst ever"verdict for Nakanishi, everyone expected that Nezu would be stripped of their teaching licenses. But on the day, total of 12 teachers received the order: Nezu and Junko Kawarai received suspencion orders of six months, and Atsuko Watanabe received an order of three months. This was the third time Nezu was ordered to stay away from teaching for six months, but she barely escaped heavier reprimand after getting several suspencion orders. "I was able to escape it because many people supported me," Nezu said at a press conference, while Ms. Kawarai said: "Even then, the reprimand is a serious one. But we will not give up." (By M. 根津さんをクビにできず!~都教委が12人の教員に処分発令
 3月31日、都教職員研修センターで「君が代不起立」の処分発令があった。午後3時すぎ、根津公子さんが発令書を手に建物から出てきた(写真)。満面の笑み、手で丸をつくっている。その瞬間、支援者から歓声が上がった。26日の「最低最悪」の中西判決を受け、誰もが「免職処分」を予測していたからだ。この日処分された教員は12名で、根津さんと河原井純子さんは「停職6月」、渡辺厚子さんが「停職3月」だった。根津さんは3度目の「停職6月」だが、転勤もなく「累積加重処分」をぎりぎりで食い止めた。「大勢の人が一緒にたたかってくれたから」と根津さん、河原井さんは「それにしても重い処分。でもあきらめない」と記者会見で語った。(M) ・動画(UnionTube)

Behind Coercion of “Kimigayo” ~ Evening with Film “I Will Not Give Up,” Lecture



On Nov. 26, about 200 people gathered at Tokyo’s Nakano Zero Hall to see a documentary, “I Will Not Give Up – Resistance to Stand for Kimigayo National Anthem,” and hear political scientist, Osamu Watanabe, speak for an hour on neo-liberalistic educational reform, which, he sees, lies behind the government’s coercion to stand up for Kimigayo. “What the financial sector wants is to change schools into places where they raise elites and obedient workers necessary for corporations by brining market fundamentalism. Tokyo Governor Shintaro Ishihara suppressed teachers’ resistance force by holding teachers’ conferences only for formality, and enforcing teachers to stand up for the national anthem because he needed to control them for his reforms,” Watanabe said. In order to protest, we must “begin reconstructing unions and bring together comrades.” Watanabe’s lecture was thought-provoking for the future struggle. (M)






「君が代強制」の背景にあるもの~映画「あきらめない」と講演の夕べ

 11月26日、東京・なかのゼロ小ホールで「あきらめない-続・君が代不起立」上映と講演の夕べが開催され、約200人が集まった(写真)。政治学者の渡辺治さんが1時間にわたって講演し、「君が代強制」の背景にある「新自由主義的教育改革」の狙いを明らかにした。「財界が望んでいるのは、教育に競争原理を持ち込み、学校を企業に必要なエリート養成と従順な労働者づくりに変えること。それをスムーズに行うためには教員統制が必要で、石原都教委は"職員会議の形骸化"や"君が代強制"を通して、教員の抵抗力を抑え込んだ」と分析。それに対抗するには「組合の再建、仲間づくりから始めるしかない」と提言した。渡辺氏の講演は今後のたたかいに大いに示唆を与えるものだった。(M)
