We successfully reinstated our comrade〜NUGW Tokyo Tobu Tama Milk Branch struggle

 

Members of Tama Milk Branch of National Union of General Workers Tokyo Tobu on Sept. 25 won the reinstatement of their member who was unfairly dismissed. The collective bargaining session was held for the first time since the dismissal on Sept. 13 at the office of NUGW Tokyo Tobu, where 13 members attended along with the NUGW Tokyo Tobu secretary general.

“I’ve worked earnestly at Tama Milk for more than 20 years,” the union member who was unfairly dismissed said. “I could not be persuaded into leaving work as a dismissal is equally serious as a death sentence.” To this response, other members started shouting, “Immediately reinstate Suzuki (the dismissed member)!” The solidarity of the union members was so strong that the company promised to re-consider its decision. 仲間の雇用を守ったぞ！～東部労組多摩ミルク支部「不当 雇い止め」を撤回させる

東京・葛飾で食品の配送を手がけている多 摩ミルクグループの労働者でつくる全国

一般東京東部労組多摩ミ ルク支部の鈴木明組合員に対する不当な雇い止め解雇の会

社方針 が9月25日に撤回されました。解雇通告後に初めての団体交渉が9 月13日に東

部労組事務所で開かれました。13人の支部組合員と東 部労組本部の須田書記長が交

渉に臨みました。鈴木さん自身が 「20年以上もまじめに多摩ミルクで働いてきた。

それを解雇とい う労働者にとっては死刑に等しい処分を会社が打ち出してきたこ と

には絶対納得いかない」と真剣に訴えました。これに他の組合 員が応え、「鈴木さ

んをただちに職場に戻せ！」の声が次々と起 こりました。組合員の団結に圧倒され

た会社側が処分の再検討を 行うことを約束し、団体交渉は終わりました。（須田光

We abolished fixed overtime pay system!～A breakthrough in court for workers

 

Three union members and the company HBS of Tama Milk Group settled out of Tokyo District Court on April 12 in a lawsuit demanding the payment of unpaid overtime wage as the union claimed fixed overtime pay was invalid. The drivers of HBS, which transport foods and drinks in Tokyo’s Katsushika Ward, joined the National Union of General Workers (NUGW) Tokyo Tobu and founded Tama Milk Branch. The settlement stipulates that the company pay the settlement money, which must be satisfactory for the union members in place of unpaid overtime pay, as well as eliminate the system of fixed overtime pay, which accounted for half the wages. The company must also incorporate the large part of it to the basic salary, which will correct future working conditions. Please note due to the non-disclosure clause, details cannot be discussed. The struggle and its result proved that if we are united as a union and raise a voice, we can eliminate the fixed overtime pay system. (by SUGA Mitsuteru )

固定残業代制度を廃止させたぞ！～東部労組多摩ミルク 支部裁判が画期的解決

東京・葛飾で飲食品を輸送している「多摩 ミルクグループ」の労働者でつくる全国

一般東京東部労組多摩ミ ルク支部のうち、同グループの株式会社エイチ・ビー・エ

スでド ライバーとして働いている３人の組合員が、固定残業代の無効を主 張したう

えで未払い残業代などの支払いを東京地裁に求めた裁判 で、４月12日、組合側の主

張がほぼ認められる内容で解決（＝和 解成立）しました。解決の主な内容は、過去

の未払い残業代とし て組合員が納得できる額の解決金を会社が支払うとともに、今

後の 労働条件は賃金の半分をも占めていた固定残業代を廃止し、その 大部分を基本

給に組み込む賃金に是正させるものです。なお、金額 等は非開示条項があるため明

らかにできないことをご了承くださ い。今回の多摩ミルク支部の闘いとその成果

は、労働組合で団結 して声をあげれば固定残業代制度をなくすことができるという

こ とが証明できました。（須田光照）
