Stop single crew operation at Sukiya Statement of the Tokyo Youth Union

Tokyo Youth Union issued a statement after a third party committee on the improvement of working conditions in Sukiya chain restaurant released a report of its survey and Zensho, the managing company of the chain, gave a press conference.

The statement demands that Zensho stop single crew operation immediately and  improve  working conditions.

Since 2013, the Tokyo Youth Union has organized employees of the fast-food chain restaurant and has been pressing the company to resolve the problems through collective bargaining. The union argues that the fast food chain's practice of having employees work alone on the midnight shift, is against the Labor Standards Law, because workers cannot take break time stipulated by the Law. Zensho has failed to address the problem and refused to negotiate with the union, saying “If the union wants to negotiate the working conditions of workers in all the chain restaurants, we will not sit at the table”.

「すき家」のワンオペを即時廃止せよ！～首都圏青年ユニオンが声明

首都圏青年ユニオンは、すき家の労働環境改善に関する第三者委員会の調査報告書の発表とゼンショーの会見を受けて、すき家で働く従業員を組合員としている労働組合として、以下の声明を発表する。１、ゼンショーは、ワンオペの即時廃止と労働条件の改善を行え 。首都圏青年ユニオンは、団体交渉などにより、調査報告書に見られるような実態をゼンショーに突き付け、解決を迫ってきた。特に深夜１人で働く「ワンオペ （ワン・オペレーション）」については、２０１３年１月の団体交渉の申し入れでも「法定休憩が取れず、労働基準法違反である」旨を、追及していたが、ゼン ショーは具体的な対策をとってこなかった。ゼンショーは今年７月１１日の段階でも「すき家全店におけるものであれば、団体交渉には応じない」旨の回答に終始し、問題に向き合うことなく、話し合いを事実上拒否し続けてきた。（首都圏青年ユニオン）

Increased Significance of Individual-Affiliated Unions: Zensho Apologizes for Rejecting Collective Bargaining

General Union of Young Workers in Tokyo (Shutoken Seinen Union) agreed with Zensho Co., the holding company of Sukiya beef-bowl chain, to settle the case where the restaurant operator had kept refusing to have collective bargaining sessions with the union. The settlement was finalized on December 21 at Tokyo District Court. The union had a news conference on December 25 at the Ministry of Health, Labor and Welfare. (Photo)  Part-time workers of Sukiya joined the union that is based on individual affiliation and had been struggling since 2007 to reclaim unpaid overtime and improve their working conditions in general. Zensho, however, kept refusing to have a collective bargaining session, claiming that an individual-affiliated union is not a qualified negotiating party. While Tokyo Metropolitan Labor Relations Commission and Central Labor Relations Commission ordered the company to have bargaining sessions with the union, Zensho filed a suit against Central Labor Relations Commission demanding for the dismissal of its ruling. The present settlement in favor of the union has reconfirmed the ever increasing importance of labor unions based on individual affiliation and community unions. 個人加盟ユニオンの意義高まる～すき家のゼンショー団交拒否を謝罪

牛 丼すき家を経営する株式会社ゼンショーが労働組合・首都圏青年ユニオンとの団体交渉を拒否している件について、12月21日に東京地裁で和解が成立し、 25日に厚労省で記者会見が行われました（写真）。すき家で働くアルバイトたちがユニオンに加入し、残業代未払い是正など労働条件改善を求めていました が、ゼンショーは「個人加盟の労組は労組と認めない」として団交を拒否。この間、ゼンショーは、都労委・中労委と「ユニオンとの団交拒否は不当である」と 命令が出されたため、命令取消を求める行政訴訟も起こしていました。今回の和解を契機に、ローカルユニオンや一人でも入れる個人加盟労働組合の存在意義を さらに高め、非正規雇用労働者の労働条件を改善していく運動をますます旺盛に展開していきます。 （首都圏青年ユニオン・山田真吾） 報告・毎日新聞・しんぶん赤旗

Workers fighting against evil companies that snapped back at unions

 

 Some 120 people, including a unionist from Turkey, attended an event titled, “Workers fighting against evil companies—Part II,” on May 18. Union members reported their struggles and their commitment to their struggles. An Osaka City worker, who is resisting tyrannical Osaka mayor said that his workplace turned into a place where workers cannot speak of their minds for fear that they would be reported and reprimanded. A union member of Suki-ya, a Japanese fast-food chain, revealed that the company refused to re-employ union members after the Great East Japan Earthquake. Another one at Miyako Mainichi Shimbun Union said that the company president forced union members to remain seated all day without any work assigned except when going to the washroom. Tour guides reported on their company, Hankyu Travel Support, and how it sued the union president for responding to an interview and stopped assigning him any work. A former KDDI phone operator reported how her company suspended all  business operations and dismissed workers for establishing a union. The last but not least case was a school office worker who was arrested for demanding that the principal attend a collective bargaining session. All struggles were unbelievably strange.  ブラック企業に立ち向かう仲間たち～逆ギレなんてとんでもない！

 5月18日、「ブラック企業に立ち向かう仲間たちの集会」、通​称・逆ギレ集会part2が開かれました。橋下市政下で​のストをはじめ、ブラック企業 ・使用者に対抗する現場か​らのプロテストが次々に紹介され、深い想いが語られ、互​いに元気をもらう、感動的な集会になりました。トルコの組合活動家を含む、120人が参加しました。

「密告を恐れ、ものが言えない」（大阪市）、「震災の支​援からも外された」（宮城県内のすき家）、「仕事を与え​ず『 トイ レ以外立つな』と1日中椅子に座らせた」（宮古​毎日）、取材に応じたことを口実に組合支部長から仕事を​すべて取り上げた（阪急トラベルサポート）、組合をつくったら業務を廃止​し職場全員解雇された（KDDIエボルバ）、挙句の果て​は「校長との団交を理由に逮捕された」（がくろう神奈​）など、駆け つけた仲間たちから明かされた攻撃は、信じ​がたいほど異常なものばかりでした。（北健一） 　＊写真＝登壇した「すき家」とたたかう仲間

General Union of Young Workers in Tokyo Wins Lawsuit against Sukiya

Tokyo District Court ordered Zensho Co, a gyudon chain, to respond faithfully to collective bargaining sessions with General Union of Young Workers in Tokyo (Shutoken Seinen Union). The company took the central labor commission in 2007 to court in demand for dismissing its ruling. Zensho’s defeat officially recognizes its illegal act to refuse collective bargaining sessions for the third time. Unlawful act by Japan’s number one restaurant operator should not be allowed. Zensho should immediately respond to the collective bargaining with the union. It is not easy for part-timers and casual workers to join a union for their rights, but the unionists will not give up. We are determined to continue the struggle until our rights are respected. We call on other casual workers and supporters never give up even if forced to work in a terrible working conditions and to stand up together. (By General Union of Young Workers)

  

全面敗訴！～首都圏青年ユニオンとの団交を命じる東京地裁判決

牛丼すき家を経営するゼンショーが、2007年以来、首都圏青年ユニオンとの団交を拒否していることに対して、すでに都労委命令、中労委命令が出ているが、中労委命令の取り消しを求める裁判で、原告のゼンショーが敗訴した。すき家・ゼンショーは、三度にわたり団交拒否の違法性が認定された。外食産業第一位企業の違法を許すことはできない。すき家・ゼンショーは、ただちに団交に応じるべきである。アルバイトやパート労働者が労働組合に加入してたたかうということは並大抵のことではない。しかし、私たちの組合員があきらめることはない。自らの生活と権利の獲得のために奮闘し続けることを決意している。私たちは、今回の裁判勝利を経て、さらにゼンショーの違法行為を厳しく糾弾するとともに、広く非正規労働者に、破壊的な労働環境でもあきらめずに立ち上がることを呼びかけるものである。（首都圏青年ユニオン）
