Anti-Nukes tent evicted!




After nearly five years, the Anti-Nukes tent in front of the Ministry of Economy, Trade and Industry was evicted on August 21th in an early morning raid. At 3:40 am, there were five people in the tent and only two were awake. Eviction officers and the police came and ordered them to leave the tent within ten minutes. All the surrounding roads and the exits of the nearby subway station were blockaded. When the five people left the tent, the eviction started and within an hour everything was removed. Some major media were notified of the eviction, so the eviction process was covered by a few reporters and a camera crew. By the time the supporters of the tent rushed to the site, the eviction was already finished. More than a hundred people gathered for a protest meeting held at the tent site. Voices of anger and resolution were raised from the protesters: “Nuclear plants should be removed, and not the tent,” “Now every one of us will be the Anti-Nukes tent.” “We will fight to the end.” (M)

「われわれがテント!負けないで続ける!」〜脱原発テント強制撤
去される

それは821日の未明、午前340分だった。5人の泊まり番のうち
起きていたのは2人。そこに、裁判所執行官・経産省職員・警察の
人間があらわれ「10分以内に私物をもって退去せよ」と通告した。
すでに周辺の地下鉄出口3か所と周辺道路はバリケードで封鎖され
ていた。5人が退去すると「テント撤去」作業が開始され、約1時間
で撤去が終わった。一部マスコミは事前に知らされていたようで、
三脚をたてて撤去の様子を撮影していた。未明に電話やメールで
知った支援者らが駆け付けたが、すでに作業は終わっていた。続い
て午前6時半に抗議集会、9時から記者会見、13時から抗議集会と、
テント跡地では断続的に抗議行動が取り組まれた。「撤去すべきは
原発でテントじゃない」「今度はわれわれ一人ひとりがテント」

Victory for the homeless: Lawsuit for state compensation against their eviction from Miyashita Park, central Tokyo

On March 13, 2015, a decision was made by the Tokyo District Court on the demand for state compensation against the eviction of the homeless from Miyashita Park in the Shibuya district, Tokyo.
Nike acquired naming rights for the formerly public park and has excluded the homeless and poor people from the park ever since. The decision also referred to illegality of the major manufacturer of sports equipment.
 The court suggested the following four points as being illegal.
1. The plan to change the park has not been approved by the Shibuya Ward Assembly.
2. The plan has not been subjected to competitive bidding.
3. The homeless who had to live in the park were evicted in an unacceptably forcible manner.
4. An opportunity to explain against the eviction has not been given with regard to the procedure to administrative subrogation.
 The court approved a compensation of 110,000 Japanese yen (900 US dollars) for the homeless.
 YAMAMOTO Shizu, attorney for the plaintiffs, says, “It is particularly important that the court referred to illegality of not only the forcible eviction but also Nike’s acquisition of Miyashita Park. Now, a big real estate company starts to take initiative to develop the park into ‘New Miyashita Park’, but this decision possibly works as a brake against the move”.

宮下公園の野宿者強制排除「国賠訴訟」で原告勝利判決

2011年4月20日に東京地方裁判所に提訴した宮下公園国家賠償請求裁判が、2015年3月13日に判決を迎えました。
判決は宮下公園のナイキ化の違法性にまで踏み込む判断を示したもので、まさに画期的な判決となりました。
 判決が違法と指摘した点は以下の4つです。
 ①公園の改造計画が議会の承認を経ていないこと(議決が必要な地方自治法96条の「負担付き贈与」に該当)
②競争入札をしていないこと(地方自治法234条)
③公園生活者を相当でない態様の有形力の行使をして排除したこと
④行政代執行に至る手続きで弁明の機会の付与を行わなかったこと

①と②はナイキ化のプロセスそのものが違法であると指摘したもの、
③と④は不当な排除を指摘したものです。
 国家賠償法上の違法な行為としては③のみをとりあげ、原告となった公園生活者だけの損害賠償11万円を認めました。

「強制排除のみならず、宮下公園ナイキ化計画についても違法性を指摘した点が特に重要だと思います。今、大企業による新宮下公園構想が動き出していますが、その進捗にも影響を与えることになるのでは」

Threat of eviction of the anti-nuke occupy tent Unfair ruling at the Tokyo District Court




On February 26th, judgment was given for the case on eviction of the anti-nuke occupy tent in front of the Ministry of Economy, Trade and Industry at the Tokyo District Court. 333 people queued for the 88 gallery seats. The Chief Judge MURAKAMI Masatoshi read the verdict in just three minutes, but it was nearly impossible to hear, because of the low voice. The ruling completely admitted the claim of the government and ordered the eviction of the tent and payment of 2.8 million yen for the rent and sanction fee. The gallery raised their voices against this unfair ruling and nearly ten of them were forced out of the court. One of the defendants and the co-representative of the tent, MASAKIYO Taichi, expressed his determination; “Most of the people are against nukes. No-nukes movement cannot be stopped. The fight goes on regardless of what happens to our tent”
On the next day, February 27th, there was a weekly Friday Action. A big red banner saying “No to the eviction!” was strung over the tent. Chanting continued in the bleak winds; “Stop the restart of Sendai Plant! ” “Stop the leakage!” ”Don’t hide information!” (S.M.K.)

226日のテントひろば撤去をめぐる裁判の判決が、東京地裁(村上正敏裁判長)で行われた。88席の傍聴席に333人が並んだ。福島からやってきた人もいた。しかし、村上裁判長の判決は主文のみ朗読の3分程度で、声が小さくほとんど聞き取れない。逃げるように立ち去る村上裁判長。傍聴の人たちは「不当判決だ」「逃げるな」「おかしい」と抗議の声を上げ続け、法廷から立ち去ろうとはしなかった。すると裁判長は戻ってきて今度は「退廷命令」を出し、10人近くが強制退去させられた。判決内容は、国の主張を全面的に認め、テントの明け渡しや使用料・約2800万円(1100万円+制裁金12万円)を支払え、というもの。テント共同代表で被告の正清太一さんは「みんな原発には反対。脱原発の流れは変わらない。テントがどうなろうとたたかいを続ける」と決意を語った。(M

東京地裁で脱原発テント撤去命令が出た翌227日の金曜行動。経産省前テントには「テント撤去を許さない!」の真っ赤な大きな横断幕が張られ、人びとの抵抗の意志を表していた(写真)。この日、霞ヶ関一帯には冷たい強い風が吹いていた。
