The Last Friday Anti-Nukes Demonstration and the Tent Ustreaming Program of 2012

The weekly anti-nukes demonstration in the vicinity of the Prime Minister's Office took place on 28 December, the last Friday of 2012. Many people gathered in the rain to express their opposition to restart of idle reactors and desire for the nuclear-free society. (The sign in the center of the photo says "Let's regain the country with no nuclear reactors!") SUGAI Masuo of the Association of Tokyo Residents against Kashiwazaki and Maki Nuclear Power Plants spoke in the rally, quoting the words of KUROKAWA Kiyoshi, the chairperson of the National Diet of Japan Fukushima Nuclear Accident Independent Investigation Commission, "The disaster of the Fukushima No.1 Nuclear Power Plant is not over yet."  "I doubt that Prime Minister Abe has read the report of the commission that was established with a resolution by the Diet. His administration should not take any moves before the ministers study the report thoroughly. In the report, Chairperson Kurokawa says that the lessons of the disaster must be seriously reflected to prevent recurrence, by quoting ASAKAWA Kan'ichi, a great scholar born in Nihonmatsu, Fukushima. All the Diet members must read the report carefully and make the full use of it."  (Shinya)

12月28日、今年最後の官邸前金曜デモがあった。 雨にもかかわらず多くの人が集まり、「再稼働反対」「原発ゼロ」を訴えた。「取 り戻そう原発ゼロの国」のプラカードが目立つ。マイク を握った菅井益郎さん（柏崎・巻原発に反対する在京者の会）は、「福島原発事故は終わっていない」という黒川清国会事故調査委員長の言葉を引用し、「安倍 さんは国会で決議してつくられた『国会事故調査委員会報告書』をちゃんと読んでいるか。しっかり読んでから対応すべきだ。国会事故調委員長の黒川清さん は、福島の生んだ世界の大学者、二本松出身の朝河貫一を引いて、福島原発事故を反省して二度とこうした事故を起こさぬようにと書いているが、国会議員は しっかり読んで活用すべきだ」と訴えた。 （Shinya）

At the Occupy tent in front of the Ministry of Economy, Trade and Industry, a 'tentcolor' ustream program was aired from 4 p.m. the same day. First, MARUKO Yasuko, MIYAKE Yukiko and HASHIMOTO Kumi who run unsuccessfully in the  Lower House election reveiwed the election, followed by the discussion by tent members. FUCHIGAMI Taro, the representative, and other leading members including SHIINA Chieko and FURODA Setsuko of Fukushima Women Against Nukes reflected back on the 474-day protest since the establishment of the tent in September 2011.  "Election is just one way to express our political will. Many other means are still left with us. We are never let down with the election result. We will defend our tents by all means to continue our struggle." said KURODA. In the end of the program, Johnny H sang a song that satirizes ISHIHARA Nobuteru, the Environment and Nuclear Affairs Minister of the new cabinet and the eldest son of the former Tokyo governor. After the program, a gathering was held to commemorate four tent members who passed away during the year. More than 100 people came despite relatively hard rain to observe a moment of silence in front of the photos of the deceased, refreshing their commitment to continued struggle against the nukes. (M)

経産省前テントひろばでは、午後4時から「あおぞら放送」があり、脱原発派の立候補者（丸子安 子・三宅雪子・橋本久美の各氏で今回落選）による「総選挙振り返り」があった。 また「原発いらない福島の女たち」の椎名千恵子さん・黒田節子さんやテント 代表・渕上太郎さんらが出演し、テント474日を振り返った。黒田さんは「たたかいは選挙だけでない。くじけない。やることは一杯ある。テントをつぶされ ないためにも頑張ろう」と檄を飛ばした。ジョニーHは石原伸晃に捧げる替え歌「ひよっちゃうな」を歌い、喝采を浴びた。午後5時すぎからは、100人以上 がテント前に集まり、今年亡くなった4人のテント仲間を追悼した。降りしきる雨のなか、参加者は遺影の前で黙祷し、「脱原発」への決意を新たにした。（M）

Settlement for the Canon Disguised Contracting and Unlawful Dismissal Case: Two Union Members Gain Regular Employment

The union organized by non-regular workers of Canon Inc. reached an agreement on December 20 with the camera manufacturer to settle the suit between the two out of court. The settlement was mediated by the Tokyo Labor Relations Commission. Based on the settlement agreement, the union, its five members involved in the case and Canon disclosed that Canon Inc. will 1. hire two members of the union as regular employees in its affiliated company and 2. seriously take the administrative guidance issued by Tochigi Prefectural Labor Director on September 12, 2007, that ordered to take corrective measures with the unlawful subcontracting then practiced at its optical equipment factory located in Utsunomiya, Tochigi Prefecture and continue to make efforts to prevent recurrence of any similar incidents. 組合員2名の正社員雇用を実現！～キヤノン偽装請負・雇い止め解雇争議で勝利和解

12月20日、東京都労働委員会において、キヤノン非正規労働者組合とキヤノン株式会社との間で和解が成立した。この和解においてキヤノン非正規労働者組合、 組合員5名、キヤノン株式会社は以下の内容を開示することについて合意した。

・キヤノン株式会社はキヤノンの関連会社においてキヤノン非正規労働者組合の 組合員2名を正社員として雇用する。

・また、キヤノン宇都宮光学機器事業所宇都宮光機第一工場光学製造部製造第二課第2ブロック（当時）における構内請負 について、平成19年9月12日付で栃木労働局長より、労働者派遣法違反が存する旨の是正指導を受けたことを真撃に受けとめ、今後は同様の指導等を受ける ことのないよう、再発防止に向けた不断の取組を継続する。（12/21組合側声明）

On December 27, the plaintiffs dropped the case that they filed with Tokyo District Court in 2009. In the press conference held at the reporters club in the courthouse, AKUTSU Shin'ichi (photo) reviewed their struggle. "It has been six years and two months since we formed the union and three years and four months since we were fired. All the time, we had sought for an opportunity to have honest talks with Canon, but, unfortunately, the company had never acted sincerely, which prolonged our struggle . Thanks to the support by many people and the efforts of our lawyers, the case has finally been settled in favor of us. Since the Supreme Court's unjust ruling for the case of disguised contracting by Matsushita Plasma Display in 2009, temporary workers involved in similar unlawful labor practices have lost hope in judiciary remedies. They have been deprived of any means to fight against employers. We truly hope that our success will encourage others in similar circumstances to raise their voices against any violations of workers rights, " he said. (By KUISAKO Ryuta)

「ダメなものはダメだ」と声上げられる社会に～キヤノン争議「勝利和解」で阿久津さん
キ ヤノン偽装請負・雇い止め解雇争議の勝利和解に基づいて、12月27日原告側は東京地裁で訴えを取り下げた。

その後、弁護団と当該による会見が司法記者ク ラブで行われた。原告の一人・阿久津真一さん（写真）はこう語る。 「組合をつくってから6年2ヶ月、解雇されてから3年4ヶ月、私たちは常にキヤノンに対 して真摯に話し合うよう申し込んできたが、残念ながら話し合いがされないまま、事件は長期化した。その中で、多くのみなさんのご支援をいただき、弁護団の 尽力もあり、この12月20日、キヤノンと和解を取り交わすことができた。 松下PDPの最高裁不当判決以降、『偽装請負・違法派遣では訴訟すら起こせな い。違法があっても声すら上げられない』という状況にある中で、『ダメなものはダメだ』と労働者が声を上げられる・・・。私たちの解決がそういう解決にな るよう本当に願っている」。（杭迫隆太） 報告・レイバーネットTVアーカイブ（キヤノン争議・44分から）

Increased Significance of Individual-Affiliated Unions: Zensho Apologizes for Rejecting Collective Bargaining

General Union of Young Workers in Tokyo (Shutoken Seinen Union) agreed with Zensho Co., the holding company of Sukiya beef-bowl chain, to settle the case where the restaurant operator had kept refusing to have collective bargaining sessions with the union. The settlement was finalized on December 21 at Tokyo District Court. The union had a news conference on December 25 at the Ministry of Health, Labor and Welfare. (Photo)  Part-time workers of Sukiya joined the union that is based on individual affiliation and had been struggling since 2007 to reclaim unpaid overtime and improve their working conditions in general. Zensho, however, kept refusing to have a collective bargaining session, claiming that an individual-affiliated union is not a qualified negotiating party. While Tokyo Metropolitan Labor Relations Commission and Central Labor Relations Commission ordered the company to have bargaining sessions with the union, Zensho filed a suit against Central Labor Relations Commission demanding for the dismissal of its ruling. The present settlement in favor of the union has reconfirmed the ever increasing importance of labor unions based on individual affiliation and community unions. 個人加盟ユニオンの意義高まる～すき家のゼンショー団交拒否を謝罪

牛 丼すき家を経営する株式会社ゼンショーが労働組合・首都圏青年ユニオンとの団体交渉を拒否している件について、12月21日に東京地裁で和解が成立し、 25日に厚労省で記者会見が行われました（写真）。すき家で働くアルバイトたちがユニオンに加入し、残業代未払い是正など労働条件改善を求めていました が、ゼンショーは「個人加盟の労組は労組と認めない」として団交を拒否。この間、ゼンショーは、都労委・中労委と「ユニオンとの団交拒否は不当である」と 命令が出されたため、命令取消を求める行政訴訟も起こしていました。今回の和解を契機に、ローカルユニオンや一人でも入れる個人加盟労働組合の存在意義を さらに高め、非正規雇用労働者の労働条件を改善していく運動をますます旺盛に展開していきます。 （首都圏青年ユニオン・山田真吾） 報告・毎日新聞・しんぶん赤旗

Result of December 16 General Election : Hitler Delivered!

The Lower House election held on December 16 resulted in a landslide victory of Liberal Democratic Party and a crushing defeat of Democratic Party of Japan. The LDP won 294 seats out of 480, while the DPJ won only 57. Nippon Ishin no To (Japan Restoration Party) became the third with 54 seats. The scale of the victory and the defeat of the two major parties were much larger than previously forecast by mass media. Communist Party and Social Democratic Party, the two traditional liberal parties, both reduced seat counts from 9 to 8 and from 5 to 2 respectively. As has already been pointed out by foreign media, Japanese society will drift further to the right and a dark era of poverty, fascism and war will arrive soon. Four major factors may be named as the main causes for the above-mentioned election result: 1. Voters' disappointment with the government of Democratic Party of Japan;  2. growing nationalistic sentiment that was fueled by territorial disputes including that of Senkaku Islands;  3. widespread frustration felt in the Japanese society due to the stagnant economy; and 4. popularity of the economy-boosting measures proposed by LDP as a quick fix. "Thank You, Mr. Utsunomiya, for Running for the Tokyo Governatorial Election!"; Supporters Determined to Move on to the Next Stage.

In the evening of December 16, the election campaign office of UTSUNOMIYA Kenji, the former chairperson of the Japan Federation of Bar Associations and a renowned anti-nukes and anti-poverty activist who was standing for the governor of Tokyo, was crowded with supporters and reporters. At 8 p.m., as TV expected a landslide victory of Liberal Democratic Party in the Lower House election, the supporters were shocked and disappointed. Soon after, the news of assured victory of INOSE Naoki, the former vice-governor who was appointed as 'successor' by the ex-governor who quit to run for the Lower House election, was reported to an even greater disappointment for the Utsunomiya supporters. Utsunomiya however did not lose his spirits. Smiling, he said, "Many individuals and various citizen's groups volunteered to take part in our election campaign. The network of the people sharing the same political idea expanded during the campaign period. This is what we achieved through the last election that was a part of our continuing efforts to rebuild Japan with the four basic policies that we advocate. Let's keep our network growing and continue fighting together to realize nuclear-free Japan." After delivering the speech, he took a round in the office to shake hands with the supporters who, in return, expressed their appreciation with tears, smiles and chanting his name.  (By M)

「宇都宮さん、出てくれてありがとう」～涙と笑顔で次のたたかいへ

12月16日夜、宇都宮けんじ選対事務所は、マスコミのテレビカメラと応援の人々でごったがえしていた。午後8時にNHKテレビが「自民圧勝・政権交代」を報 じると、人々から「信じられない」「え！」と悲鳴にも似た声が発せられた。それからすぐに都知事選で猪瀬候補当確の報。重たい空気が流れた。しかし、宇都 宮けんじさんは笑顔を交えてマイクをとる。 「私たちの選挙は、みんな手弁当で様々な市民団体がボランティアで力を合わせた。この輪の広がりが今回の成果 だ。選挙は運動の一つであり、大事なことはこの輪を広げること。脱原発など4つの基本政策は日本を救う道であり、その実現のために引き続き一緒にがんばっ ていきたい」。  その後、支援者一人ひとりと握手。「先生、出てくれてありがとう」涙と笑顔・・。そして「ケンジ！ケンジ！」のコールが事務所に響き渡っ た。 （M）
