High school student refuses to stand for the Kimigayo




It is already 12 years since teachers in Tokyo were force to stand and sing the National Anthem, Kimigayo, at commencement ceremonies. Also in Osaka, an ordinance was made 3 years ago to make it possible to dismiss teachers when they disobey three times the orders to stand up and sing.. But last year, a student graduating a Osaka City municipal high school handed out a flyer at the gate of the school on the day of the ceremony and refused to stand and sing.
On February 21th, there was a meeting in Tokyo to hear the story of this student, KIMURA Hibiki, now a first year undergraduate. She said, “I was taught from my father that Kimigayo is a song wishing the eternity of Emperors’ rule”. As the day of the ceremony drew near, she was still wavering. But encouraged by the headmaster, she remained seated during the ceremony, although her legs were trembling. (SASAKI Yumi)

東京の教育現場で「日の丸・君が代」強制が始まって12年がたつ。大阪でも3年前に「職員基本条例」が作られ、3回不起立をした教員は免職になる。こうした 中で昨年(2014年)の春、卒業式の当日に学校の門前で自分の思いを書いたチラシを配り、不起立をした大阪府立高校の卒業生がいた。221日東京・ス ペースたんぽぽで、その高校生・木村ひびきさん(現在大学1年)のお話を聞く会が開かれた。70名の参加者で会場はあふれた。木村さんは、父親から「君が 代」が「天皇の世が続くように」という歌だと聞いていた。中学校の卒業式が近づき、不起立をするかどうか迷っていた。まわりの反応がこわかったからだ。 (佐々木有美)

Osaka Prefectural LRC approves survey on government workers as unfair labor practice



 
 Osaka Prefectural Labor Relations Commission approved on March 25 that the survey conducted by Osaka City last February on all city workers is an unfair labor practice that is prohibited under Japan’s Trade Union Law. The survey was about political and union activities of all city workers. The commission ordered the city government to submit a written oath to the union that it would never take such an action again.
 Osaka Mayor Toru Hashimoto apologized for what he did. “I will run the city government according to the law,” he said at a press conference after the order was issued. He added that he intended not to file a protest to the decision. However, he changed his attitude in the evening of the same day by saying, “It is wrong for the union to tell me to apologize as though it has won all the games in town without reflecting on what it has done in the past. What we must argue we must argue. Otherwise, the union will get everything it wants.” According to the commission’s ruling, the survey asked whether or not the workers participate in union activities, advantages of being a union member, disadvantages of not being a union member or discontinue membership.  「職員アンケートは不当労働行為」大阪府労委が認定~橋下市長は命令を受け入れよ
 大阪市が昨年2月に全職員を対象に実施した、「政治・組合活動に関する職員アンケート」は、労働組合法が禁止する 不当労働行為に当たるとして、大阪府労働委員会は3月25日、「今後はしない」との誓約文を組合側に渡すよう大阪市に対して命令しました。橋下市長はこの 命令を受けて記者団に対して、「大変申し訳ない。法に基づいた行政運営をしていく」と謝罪し、不服申し立てをしない意向を表明しました。しかし、同日夕方 になって一転して、「組合の振る舞いを全部棚に上げて、鬼の首を取ったように謝れというのは違う。争うべきところは争わないと、全部組合の主張が通ってし まう」と態度を一変させました。命令書によると、組合活動の有無や加入のメリット、加入しない(脱退する)デメリットなどをアンケートで尋ねたことについ て、「組合員に動揺を与え、加入していない者にも加入をためらわせかねない」と指摘しています。(なかまユニオン大阪市職員支部長・矢野幸一)

Nakama Union declares to fight the unfair discipline on tattoo


 



Osaka City government reprimanded 6 employees who refused to answer the questionnaire on tattoo on August 28. Nakama Union, which organizes three of the refusers, held a press conference to openly criticize the City Mayor, HASHIMOTO Toru. “To have a tattoo or not is a personal matter and is a part of freedom of expression protected by Article 21 of the Japanese Constitution. It is an infringement of human rights to investigate employees on tattoo by a work order.” said the Union. The Mayor is threatening to discharge employees who repeatedly refuse to obey the work order. The 37 thousand city employees are under the tyranny of HASHIMOTO, unable to speak up. But the six refusers braved themselves to say what is wrong is wrong. Nakama Union issued a statement this day, declaring to fight on till the reprimand is retracted. (M)

大阪市、入れ墨調査拒否者に不当処分!~なかまユニオンが闘争宣言

阪市は828日午前9時、入れ墨調査拒否者6名に対して戒告処分を発令した。拒否者3名が所属する「なかまユニオン」は記者会見を開き、「人が身体に入 れ墨やタトゥーを施すことは、憲法第21条に保障された表現の自由であり、人格権の一発露でありプライバシーの問題。それを職務命令として一律に調査する ことは人権侵害に当たる」と橋下市長の暴走を真っ向から批判した。「業務命令違反が続けば免職」という橋下市長の暗黒政治で、3万数千人の市職員は一切も の言えぬ状況に置かれてしまったが、その中で「おかしいことはおかしい」と声を上げた貴重な6人だった。この日「なかまユニオン」は声明を出し、処分撤回 を求めて最後まで闘うことを宣言した。(M 写真速報・闘争宣言(なかまユニオン)・拒否者の思い・記者会見動画(YouTube)・TBSニュース *写真=なかまユニオン井手窪委員長(左)と今回処分を受けた矢野幸一さん(右)
