Final victory for NEZU Kimiko’s Kuimigayo case

“I never thought I could win such a verdict” said NEZU Kimiko excitedly. In 2007, NEZU was suspended for 6 months  for not standing up while the national anthem “Kimigayo” was played in a commencement ceremony at a junior high school in Tokyo. Her colleague KAWARAI Junko was suspended for 3 months. Nezu filed a lawsuit and last year, the Tokyo High Court ordered the annulment of the suspension and the payment of 100 thousand Yen for damages. On May 31th, the Supreme Court turned down the appeal. This was the first time that Nezu won a legal case. A meeting to report this victory was held in Tokyo on June 19^th. Some of her ex-pupils attended the meeting and one of them aged 25 commented, “I celebrate this victory, as if it were my own. I heard at that time from the headmaster that Nezu was suspended for not singing the Kimigayo and thought it was not right. So I made a handout about the national anthem and gave it to her. I talked a lot with her and learned from her the importance of maintaining one’s thoughts.”(SASAKI Yumi)

「自分の考えをつらぬくことを学んだ」～根津さんの教え子も勝訴を祝福
 

「まさか生きている間に、こんな勝利判決が確定するとは思っていなかった」と根津公子さんは声をはずませた。5月末日最高裁は都の上告を棄却した。これで、 「君が代」不起立に対する根津さん6カ月、河原井純子さん3カ月の停職処分取り消し、都にそれぞれ10万円の損害賠償を命じた高裁判決が確定した。根津さんの数ある裁判の中でこの勝利判決は初めてのことだった。6月19日、裁判勝利報告集会が中野商工会館で開かれ、約60名が参加した。この集会には、根津さんの教え子も参加した。今年25歳になるEさんは、次のように話した。「今回の勝訴は自分のことのようにうれしい。当時、校長から先生が停職になったの は、『君が代』を歌わなかったからと聞いて、おかしいと思った。新聞のチラシを参考に『君が代』のことをプラカードにして先生にわたした。門前で先生とたくさん話をした。先生の不起立をつらぬく姿勢から、自分の考えをつらぬくことを学んだ」。（佐々木有美） 　＊写真＝河原井純子さん（左）と根津公子さん

Supreme Court rules out reprimand for refusing to stand for Kimigayo

 My name is NEZU Kimiko, who was reprimanded for not standing up for national anthem, “Kimigayo,” by Tokyo Metropolitan Board of Education. This is big news!

 The Supreme Court dismissed the Tokyo education board’s appeal of the Tokyo high court’s decision, which rejected 6-month suspension of Nezu and granted a 100,000 -yen compensation for each of the two plaintiffs on May 28 last year. The Tokyo education board appealed to the supreme court, but as of May 31 the court rejected the appeal on unanimous vote.

 I am so grateful for the decision. I never expected to hear the victorious ruling in my lifetime. I want to thank all of you who supported our struggle. (By NEZU Kimiko)

「君が代」処分取り消しのビックニュース～最高裁が 「都教委のやりすぎ」に歯止め

「君 が代」不起立で東京都教委から処分され続けた根津公子です。「君が代」処分取り消しのビックニュースです！ 昨年5月28日、東京高裁（須 藤典明裁判長）は2007年「君が代」不起立停職6月処分取り消しと損害賠償を求めた事件で、根津・停職6月処分の取り消し と河原井さん・根津の損賠（各10万円）を認める判決を出しました。敗訴した都は、根津・停職6月処分と2人の損賠につ いて、上告及び上告受理申し立てを していましたが、最高裁第3小法廷 は、5月31日付 で都の「上告を棄却」し、「上告審として受理しない」ことを「裁判官全員一致の意見で決定した」との 「決定」を出しました。本当にうれしいです。昨年の須藤判決が出されたときにも思いましたが、生きているうちに、しかもこんなに早くに勝訴判決を手にする とは思いもしなかったことです。勝訴判決を手にできたのは、大勢の方が支援して下さったおかげです。皆さん、ありがとうございま した。（根津公子） 報告・時事通信・渡部通信　＊ 写真＝高裁勝訴を喜ぶ根津さんと河原井さん（2015.4.28）

Let’s get connected with students and young people! ～ Ouchi Hirokazu speaks at ‘Hinomaru and Kimigayo’ gathering

 It’s been 13 years since the Tokyo metropolitan government began enforcing the “Hinomaru (national flag raising) and Kimigayo (singing of the national anthem)” at public schools in Tokyo. A gathering against this enforcement was held in Suginami Ward in Tokyo on Feb. 13. The meeting, which was promoted by a Tokyo network against the board of education, drew about 100 people.

 At first, OUCHI Hirokazu, Chukyo University professor (see photo), gave a lecture titled,  “Security legislation and Education.” Ouchi, who has shined a light on abuses against part-timers and led the movement to tackle issues surrounding student loan, pointed out that it is important to think about anti-security legislation and poverty together.

 He said, “neo-liberalism have driven income gap and poverty to the worst level. About half of young people live under 3 million yen a year. The number of workers who cannot afford to live is increasing. It is necessary to criticize impoverishment as well as dismantling of constitutionalism. In short, a movement that brings power shift to the relationship between wage labor and capital is being sought.

「食べられない」学生・若者たちと繋がろう！～2.13「日の丸・君が代」集会で大内裕和さん
 

 東 京の公立学校で「日の丸・君が代」の強制が始まって13年がたつ。2月13日、「日の丸・君が代」強制反対！2・13総決起集会が、東京・セシオン杉並で 開かれた。主催は都教委包囲首都圏ネット。100人が集まった。冒頭、大内裕和さん（中京大学教授/写真）が「安保法制と教育」と題して講演。ブラックバ イトや、奨学金問題に光をあて、救済運動をリードしてきた大内さんは、反安保運動と貧困問題をつなげることが大切だと指摘した。「新自由主義で格差と貧困 は極限まで達している。若年層のほぼ半数は、年収300万円以下。食べられない労働者が増加している。『立憲主義』解体への批判とともに、貧困化への批判 が必要だ。つまり『賃労働と資本』の場における力関係を変える運動こそが求められている」と語った。（佐々木有美） 続き・渡部通信
