National Rail-workers Union activist SAKUMA Tadao passes away – In respect for each activist

Sakuma encountered the air raid during World War II in 1945, when he joined the Japanese National Railways at the age of fourteen. Ever since, he had been an activist of the National Rail-workers Union (Kokuro) and a symbol of the struggle for the reinstatement of 1,047 former JNR workers who were dismissed in the process of the JNR’s privatization. Also, Sakuma is one of the heroes of a documentary film “Be More Human – Kokuro’s 15-Year Struggle” produced by Video Press. He had been trying to recuperate from prostate cancer since two and a half years ago. His family members contacted me on July 8, 2016, saying that he had fallen into a critical condition. I got to the hospital in Tokyo to see him on the following day. Although he was blind and unable to talk, he answered me when I talked to him. He also reacted to NEZU Kimiko, who filed a lawsuit against an unfair practice of the Tokyo Metropolitan Education Board for refusing to stand up during the playing of Kimigayo, Japan’s controversial national anthem. She won the lawsuit at the Supreme Court. At 6:40 am on July 10, Sakuma passed away peacefully at the age of 85. (MATSUBARA Akira)

「人らしく生きよう」佐久間忠夫さん逝去～一人ひとりが主人公の運動求めて

1945年に大空襲を体験し、その年14歳で国鉄に入社。以来、国労運動ひとすじの 佐久間忠夫さんは、JR不採用・1047名解雇撤回闘争のシンボル的存在でした。ま たビデオプレスがつくったドキュメンタリー映画『人らしく生きよう－国労冬物 語』の主人公です。2年半前から、前立腺がんで東京・大田区の病院で療養して いました。私が、佐久間忠夫さんの家族から「容態が悪化した」と連絡を受けた のは7月8日でした。翌9日、病院に駆けつけました。眼は見えず話もできません でしたが、耳は聞こえるようで、耳元で「来たよ」というと「うん、うん」と首 をふります。一緒だった根津公子さんは、佐久間さんに「毎回傍聴にきてくれた 停職処分裁判に最高裁で勝利したよ。本当にありがとう」と語りかけると深く頷 いていました。そして、翌朝10日の6時40分に息を引き取りました。延命措置は しなかったので、苦しむこともなく枯れるように亡くなりました。85歳でした。 （松原明）

Final victory for NEZU Kimiko’s Kuimigayo case

“I never thought I could win such a verdict” said NEZU Kimiko excitedly. In 2007, NEZU was suspended for 6 months  for not standing up while the national anthem “Kimigayo” was played in a commencement ceremony at a junior high school in Tokyo. Her colleague KAWARAI Junko was suspended for 3 months. Nezu filed a lawsuit and last year, the Tokyo High Court ordered the annulment of the suspension and the payment of 100 thousand Yen for damages. On May 31th, the Supreme Court turned down the appeal. This was the first time that Nezu won a legal case. A meeting to report this victory was held in Tokyo on June 19^th. Some of her ex-pupils attended the meeting and one of them aged 25 commented, “I celebrate this victory, as if it were my own. I heard at that time from the headmaster that Nezu was suspended for not singing the Kimigayo and thought it was not right. So I made a handout about the national anthem and gave it to her. I talked a lot with her and learned from her the importance of maintaining one’s thoughts.”(SASAKI Yumi)

「自分の考えをつらぬくことを学んだ」～根津さんの教え子も勝訴を祝福
 

「まさか生きている間に、こんな勝利判決が確定するとは思っていなかった」と根津公子さんは声をはずませた。5月末日最高裁は都の上告を棄却した。これで、 「君が代」不起立に対する根津さん6カ月、河原井純子さん3カ月の停職処分取り消し、都にそれぞれ10万円の損害賠償を命じた高裁判決が確定した。根津さんの数ある裁判の中でこの勝利判決は初めてのことだった。6月19日、裁判勝利報告集会が中野商工会館で開かれ、約60名が参加した。この集会には、根津さんの教え子も参加した。今年25歳になるEさんは、次のように話した。「今回の勝訴は自分のことのようにうれしい。当時、校長から先生が停職になったの は、『君が代』を歌わなかったからと聞いて、おかしいと思った。新聞のチラシを参考に『君が代』のことをプラカードにして先生にわたした。門前で先生とたくさん話をした。先生の不起立をつらぬく姿勢から、自分の考えをつらぬくことを学んだ」。（佐々木有美） 　＊写真＝河原井純子さん（左）と根津公子さん

Supreme Court rules out reprimand for refusing to stand for Kimigayo

 My name is NEZU Kimiko, who was reprimanded for not standing up for national anthem, “Kimigayo,” by Tokyo Metropolitan Board of Education. This is big news!

 The Supreme Court dismissed the Tokyo education board’s appeal of the Tokyo high court’s decision, which rejected 6-month suspension of Nezu and granted a 100,000 -yen compensation for each of the two plaintiffs on May 28 last year. The Tokyo education board appealed to the supreme court, but as of May 31 the court rejected the appeal on unanimous vote.

 I am so grateful for the decision. I never expected to hear the victorious ruling in my lifetime. I want to thank all of you who supported our struggle. (By NEZU Kimiko)

「君が代」処分取り消しのビックニュース～最高裁が 「都教委のやりすぎ」に歯止め

「君 が代」不起立で東京都教委から処分され続けた根津公子です。「君が代」処分取り消しのビックニュースです！ 昨年5月28日、東京高裁（須 藤典明裁判長）は2007年「君が代」不起立停職6月処分取り消しと損害賠償を求めた事件で、根津・停職6月処分の取り消し と河原井さん・根津の損賠（各10万円）を認める判決を出しました。敗訴した都は、根津・停職6月処分と2人の損賠につ いて、上告及び上告受理申し立てを していましたが、最高裁第3小法廷 は、5月31日付 で都の「上告を棄却」し、「上告審として受理しない」ことを「裁判官全員一致の意見で決定した」との 「決定」を出しました。本当にうれしいです。昨年の須藤判決が出されたときにも思いましたが、生きているうちに、しかもこんなに早くに勝訴判決を手にする とは思いもしなかったことです。勝訴判決を手にできたのは、大勢の方が支援して下さったおかげです。皆さん、ありがとうございま した。（根津公子） 報告・時事通信・渡部通信　＊ 写真＝高裁勝訴を喜ぶ根津さんと河原井さん（2015.4.28）

To raise a voice～An encounter of a school girl and a teacher

On the local news section of the July 11 morning edition of Asahi Shimbun, I found an article titled “the youth raising their voices,” featuring young people who oppose the war bill. The article quoted FUKUDA Wakako, a senior student of Wako University, as saying, “In junior high school, I found a teacher who would not sing the Kimigayo national anthem at school ceremonies. Every morning and evening in front of the school gate, she stood and spoke about the reasons why she would not sing. ‘Isn’t it hairy?’ one of my friends said, with a faint smile. The school ignored her. I walked pass her, minding too much about what my boyfriend would think.”

 I knew right away it was about NEZU Kimiko. Nezu moved to a junior high school in Machida from Tachikawa nine years ago. She had been suspended from work for three months for not standing for Kimigayo. From the first day of her transfer to the end of the three months, Nezu--not permitted to give lessons--spoke out to the students and passersby in front of the school gate every day about the ridiculousness of forcing Kimigayo.  ( by SASAKI Yumi )

声を上げること～ 福田和香子さんと根津公子さんの出会い

 ７月１１日の「朝日新聞」朝刊社会面 に、戦争法案に反対する「声を上げる若者たち」 という特集があった。和光大学４年の福田和香子さんの 記事を読みすすむと、次のような件があった。＜中学の頃、式典で君が代を歌わない教諭がいた。朝夕校 門前に立って、歌わない理由を話す。「やばくない？」と薄く笑う友達。見ぬふりをする学校。彼氏の目を 気にして、通り過ぎた自分。＞ これは、根津公子さんのことに違いないと即座に確信した。９年前、根津 さんは、立川から町田の中学に異動。「君が代」不起立で、停職３ヶ月の処分を受けていた。転任早々の ４月から３ヶ月、授業を許されない根津さんは、毎日校門前で、生徒や道行く人に「君が代」強制のおか しさを訴えた。（佐々木有美）
